Lai Mohammed, Nigeria’s Minister of Information and Culture has vehemently denied, he made the  announcement in the increment for hate speech fine  from N500,000 to N5million.

Recall in August, the minister made the announcement and went further to explain that the increment in the fine was to stop people, whose intentions were to violate the provision to threaten the unity of the country.

In response to an initial motion filed by Inibehe Effiong, a human rights lawyer, questioning the imposition of N5m fine on Nigeria Info 99.3FM, Lagos, and the National Broadcasting Commission threatening to punish other media stations in the country over alleged hate speech, Lai Mohammed denied making the announcement in a counter-affidavit.

The affidavit reads;

“Paragraph 19 is denied. The 2nd defendant (Mohammed) did not announce an increment in any fine for hate speech from N500,000 to N5,000,000 or any other because there is a governmental body or institution mandated to regulate and enforce the Nigerian Broadcasting Code.”

The minister, further stated that for the sake of national interest, the constitution allows human rights to be suspended, added that stations that go against the NBC code can be sanctioned by the commission as stated in the NBC act.

The Minister also stressed that the NBC sanctions did not directly affect Effiong and therefore he didn’t possess the legal right to challenge the commission’s ethics.

On its part, NBC insisted that it can place a sanction on stations who broke their codes and also reiterated the minister’s stand that the applicant Effiong was not a broadcaster and therefore lacked the jurisdiction to challenge the actions of the commission.
